FIRED OFFICER WINS BACK HIS JOB BECAUSE SHERIFF VIOLATED PHYSICAL FITNESS TESTING RULES

NEPBA Attorney Peter Perroni won an important arbitration decision resulting in the reinstatement of a Middlesex Sheriff’s Officer. That officer, an NEPBA Local 500 member, was fired when he allegedly failed – by four seconds – his annual physical fitness testing run.  The arbitrator overturned the firing, and ordered the officer be reinstated with full back-pay and benefits when she ruled that the Sheriff violated both the CBA and its own policies in the testing process.
